These Terms of Service (“Terms”) govern your access to and use of www.ifectiv.aero (the “Site”), operated by IFECtiv LLC (“IFECtiv,” “we,” “our,” or “us”).

By accessing the Site, requesting access to publications, or purchasing licensed digital materials, you agree to be bound by these Terms.

If you do not agree, you may not use the Site.

1. Nature of the Site, Publications, and Services

The Site provides information regarding IFECtiv’s products and services, background information about the Founder, industry commentary, articles, activity updates, and access to industry briefings, evaluation materials, and controlled publications related to inflight entertainment and connectivity (IFEC) and related aviation industry topics.

Content published by IFECtiv reflects industry analysis and structured evaluation perspectives. It is not legal advice, financial advice, certification guidance, regulatory instruction, or operational directive.

Users remain responsible for independent evaluation and decision-making within their own organizations.

2. Controlled Access and Licensing

Certain publications are distributed through a structured, controlled access model.

When access is granted, whether complimentary or paid, IFECtiv grants a limited, non-exclusive, non-transferable, revocable license to access and use the publication solely for internal professional purposes consistent with the scope of the issued license.

Unless explicitly stated otherwise in writing:

·       Access is issued to a named individual.

·       Access credentials may not be shared.

·       Publications may not be redistributed externally.

·       Publications may not be posted publicly.

·       Publications may not be resold, sublicensed, or commercially exploited.

Organizational licenses, where offered, are governed by the scope described at the time of issuance.

IFECtiv reserves the right to revoke access in the event of misuse, unauthorized distribution, payment dispute, or violation of these Terms.

3. Payment Terms (Digital Publications)

Where publications or digital materials are offered for purchase:

·       Payment is due in full at the time of transaction.

·       Access is delivered electronically following successful payment processing.

·       Delivery of access constitutes fulfillment of the transaction.

IFECtiv does not guarantee uninterrupted platform availability but will take reasonable steps to address verified technical delivery failures.

4. Refund Policy (Digital Products)

All sales of digital publications and downloadable materials are final.

Refunds will not be issued based on:

·       Disagreement with content

·       Differing professional interpretation

·       Internal procurement reconsideration

·       Change of circumstance

Refunds may be considered only where:

·       A verified technical malfunction prevents access to the purchased material; and

·       IFECtiv is unable to resolve the issue within a reasonable time following troubleshooting.

Refund requests must be submitted in writing within seven (7) days of purchase.

Prior to submitting a written refund request, the purchaser must first contact IFECtiv here or through the designated contact page on the Site to obtain a Refund Request Code. The Refund Request Code must be included with the written submission.

As part of the review process, IFECtiv may request information reasonably necessary to validate the reported issue, including:

·       Description of the access failure

·       Device and browser details

·       Confirmation of network or firewall restrictions

·       Screenshots or error messages where applicable

Failure to provide requested validation information may result in denial of the refund request.

Users are responsible for ensuring they have appropriate systems, software, internet access, and security permissions necessary to access digital publications. Incompatibility with local systems, corporate firewalls, browser restrictions, or failure to follow access instructions does not constitute a product defect.

Where digital access is restricted due to verified corporate or technical limitations beyond IFECtiv’s control, IFECtiv may, at its sole discretion, offer alternative delivery, including provision of a printed copy shipped to an address serviced by a recognized carrier. Shipping costs may apply.

Eligibility for refund remains subject to IFECtiv’s reasonable determination.

5. Chargebacks and Payment Disputes

Initiating a chargeback after digital access has been delivered constitutes a material breach of these Terms unless the charge was demonstrably unauthorized.

IFECtiv reserves the right to:

·       Contest improper chargebacks

·       Revoke publication access

·       Deny future access requests

·       Pursue recovery of improperly reversed funds

Users are encouraged to contact IFECtiv directly to resolve billing concerns prior to initiating a chargeback.

6. Taxes

Purchasers are responsible for any applicable sales, value-added, goods and services, or similar taxes imposed by applicable jurisdictions.

IFECtiv may collect and remit taxes where legally required.

Any taxes imposed by the purchaser’s jurisdiction remain the responsibility of the purchaser unless explicitly stated otherwise.

7. Third-Party Platforms and Service Providers

Certain Site functionality, publication hosting, payment processing, marketing infrastructure, and delivery systems may be provided through contracted third-party platforms.

Access to controlled publications, digital materials, or payment services may occur through such external platforms. Your use of those platforms may be subject to their applicable terms of service and privacy policies.

IFECtiv does not control the operational policies, availability, or technical performance of third-party platforms and shall not be responsible for service interruptions, access delays, policy changes, account limitations, or technical constraints attributable to such providers.

IFECtiv will take commercially reasonable steps to facilitate access where practicable, but uninterrupted availability of third-party services is not guaranteed.

8. Advisory and Consulting Services

IFECtiv may offer advisory, consulting, or in-person services separate from digital publications.

Such services are governed exclusively by a separate written agreement executed between IFECtiv LLC and the client organization (the “Consulting Agreement”).

In the event of any conflict between these Terms and a Consulting Agreement, the Consulting Agreement shall control with respect to those advisory, consulting, or in-person services only.

These Terms govern digital publications and Site usage only.

9. Unsolicited Submissions

Unless expressly agreed in writing in advance, information submitted through the Site is provided on a non-confidential basis.

Users should not submit proprietary, confidential, export-controlled, or sensitive operational information through general enquiry forms.

IFECtiv does not assume any obligation of confidentiality with respect to unsolicited submissions received through the Site.

Submission of information through the Site does not create any partnership, agency, advisory, fiduciary, or joint development relationship.

Confidentiality obligations, where applicable, are governed exclusively by a separately executed written agreement between IFECtiv LLC and the submitting party.

10. Intellectual Property

All content on the Site and within controlled publications, including text, graphics, analysis frameworks, structure, methodology, and compilation, is the property of IFECtiv LLC or its licensors and is protected by applicable intellectual property laws.

No ownership rights are transferred through access.

You may not:

·       Modify or create derivative works

·       Remove proprietary notices

·       Reverse engineer or scrape content

·       Use content for commercial training, resale, benchmarking promotion, or external publication without written permission

Unauthorized distribution may result in legal enforcement.

11. Use Restrictions – Automated Systems and Artificial Intelligence

Content made available through the Site or controlled publications may not be:

·       Used to train, fine-tune, or improve machine learning models, large language models, or artificial intelligence systems;

·       Ingested into automated knowledge systems, retrieval systems, vector databases, or similar technologies for external or commercial deployment;

·       Systematically scraped, extracted, or harvested through automated means;

·       Incorporated into datasets used for algorithmic model development or evaluation.

Limited internal use within a licensee’s organization for evaluation or discussion purposes is permitted, provided such use does not involve external redistribution, commercialization, or model training.

Any permitted citation of IFECtiv materials must be accurate, properly attributed, and not misleading. Excerpts may not be presented in a manner that alters context, distorts meaning, or implies endorsement, sponsorship, approval, or validation by IFECtiv or its author.

12. Brand, Representation, and Goodwill Protection

The name “IFECtiv,” associated logos, publication titles, and branding elements are the property of IFECtiv LLC.

No individual or organization may represent, imply, or suggest, whether online, offline, verbally, in writing, in marketing materials, proposals, presentations, social media, conferences, or any other medium, that they:

·       Represent IFECtiv;

·       Are authorized agents of IFECtiv;

·       Are partners, affiliates, collaborators, or certified entities of IFECtiv;

·       Have been endorsed, approved, or validated by IFECtiv;

·       Have participated in joint development of IFECtiv publications or frameworks;

·       Are authorized to distribute IFECtiv materials.

Use of IFECtiv’s name, logos, publication titles, or branding elements without prior written authorization is prohibited, except for accurate and non-misleading reference in accordance with permitted citation under these Terms.

Users may not alter, obscure, or remove brand attribution from controlled publications.

IFECtiv reserves all rights in its name, branding elements, and associated goodwill.

13. Disclaimer of Warranties

Publications and Site content are provided “as is” without warranties of any kind.

IFECtiv makes no representations regarding:

·       Suitability for specific operational decisions

·       Regulatory compliance sufficiency

·       Certification alignment

·       Commercial outcomes

Users are responsible for independent validation and governance review within their organizations.

14. Limitation of Liability

To the maximum extent permitted by law, IFECtiv shall not be liable for indirect, incidental, consequential, special, punitive, or exemplary damages arising out of or related to:

·       Use of publications

·       Reliance on analysis

·       Access interruptions

·       Third-party platform interruptions

·       Payment processing issues

·       Business decisions informed by Site content

IFECtiv’s total aggregate liability arising from any claim related to a digital publication shall not exceed the amount paid for that specific publication.

Some jurisdictions may not allow certain limitations; in such cases, liability is limited to the maximum extent permitted by law.

15. International Users

The Site is operated from the United States.

Users accessing from outside the United States are responsible for compliance with applicable local laws.

Nothing in these Terms overrides mandatory rights applicable under local consumer protection laws where such laws apply.

16. Termination

IFECtiv may suspend or terminate access at its discretion for:

·       Violation of these Terms

·       Unauthorized redistribution

·       Fraudulent payment disputes

·       Misuse of controlled materials

Termination does not relieve outstanding payment obligations.

17. Governing Law

These Terms are governed by the laws of the State of Nevada, without regard to conflict of law principles.

Disputes shall be resolved in state or federal courts located in Nevada, unless otherwise required by applicable law.

18. Entire Agreement

These Terms constitute the entire agreement regarding Site usage and digital publications.

They supersede prior website terms or representations.

No waiver of any provision shall be deemed a continuing waiver.

19. Changes to Terms

IFECtiv reserves the right to update these Terms periodically.

Continued use of the Site following updates constitutes acceptance of the revised Terms.
